Ministerial Committee versus Hague Tribunal

Jeannette Chong-Aruldoss, another member of the SPP, described the Ministerial Committee as a “tragic joke”.

“It is like the Boss of a company has a quarrel with Mr Someone. Then the Boss gathers a number of his employees and empowers them to decide who is right: he (the Boss) or Mr Someone. Boss submits a long testimony to this group of his employees giving them his account of the events and his opinion about Mr Someone’s motives.

How on earth can such a group of subordinates, who are otherwise answerable to the Boss, be expected to act independently and to able to make an objective decision? Does such a dubious committee really have the option to decide against their Boss?

It is a rule of natural justice that a man cannot be a judge in his own cause: “Nemo judex in causa sua”. Asking your underlings to determine the outcome of a case in which you have a personal interest in, is to me a breach of that rule.

Tragically, the joke is on us, the citizenry. For it does not bode well for us when we cannot detect, turn a blind eye to or condone conflict of interests and use of state powers for personal benefits.”

After reading Jeannette Chong’s comment about the Ministerial Committee it straight away reminded me of the ‘UN supported’ Hague Tribunal that ruled against China on the SCS Islands case. In this tribunal, supposedly a private court that willing parties went for an arbitration but the western media trying to con the world that it was a ‘UN backed’ organization as if it was an UN body, it was set up unilaterally by the Philippines and its backers ie the USA and Japan, without China participating, chose its own judges, paid the judges to decide in their favour against China. And the Americans and some western countries including little USAs went about trumpeting that it was a fair and ‘UN backed’ court and that its decision must be complied with. Today all these silly buggers are like what the Hokien phrase said, ‘chui tat lan’, all voiceless, become dumb, after their scheme was exposed as hollow, silly and mischievous.

Now, would this kind of court be a tragic joke, ridiculous?  Setting up your own court, choosing and buying your own judges to judge against another party that did not agree and did not want to be a part of it? Compares the Ministerial Committee to this kangaroo court, which is the bigger joke? Was there any natural justice, did supporting this kangaroo court bode well for Singapore as a country that has been touting the rule of law?

After being "singled out in a NDR speech in the 1980s by old fart and shamed, labelled as a big (implied mo lan yong?) wooden block", he "still shamelessly warmed the seat and instituted a series of blunders which brought Sin Land to its knees"?

When "Long Gor" took over (in 2004), (the economy was so bad and sick) he had no choice but to "open the legs even bigger and let in more vices, supposedly over old fart's "dead boLEE" by giving the green light and opened the floodgate for more vices" to prop up the "dying economy"?

Jeannette Chong-Aruldoss, another member of the SPP, described the Ministerial Committee as a “tragic joke”.

Tiok, tragic joke.

But even more tragic and no joke is that the Sinkie opposition, including of course Jeannette Chong-Aruldoss, is not even united, let alone ready to be govt. And Jeannette was also a political frog, jumping from NSP to SPP to don't know what next.

So are Tan Jee Say, Goh Meng Seng and even the scholar couple (I think retired from politics already).

And even after 20 years, Ah Chiam and wife still bear a grudge against Chee Soon Juan.

And Chee Soon Juan even suggested SDP to be MP while WP can manage Town Council during the Punggol East by election bargaining on who to contest.

And Kenneth son of JBJ still hate WP for abandoning his late father when he was sued till bankrupt by PAP.

And rightly so, WP Teochew Ah Hia doesn't believe in opposition unity.

And so looking at this bunch of Sinkie opposition, any wonder why 70% Sinkies have no choice but to choose Hsien Loong's PAP as the lesser of 2 evils? Isn't this a greater tragedy and really no joke and with no solution?

Chateau de Holland Rd

///A VISIT to Dr Michael Lim's home is much like visiting a chateau in France but without having to endure a 12-hour long flight. The European experience starts right at the compound gate, where a pair of larger than life centurion statues stand guard.

Like with most chateaus, this one, off Holland Road, comes with an immensely long driveway, before a two-storey mansion with elaborate columns, a steeply-pitched roof, and a water fountain right up front, comes into view.

"When you look at the house, you think you are somewhere in Europe rather than in Singapore," quips Dr Lim, medical director at the Singapore Heart, Stroke & Cancer Centre, who drew up the design of his home after visiting several French chateaus and the Palace of Versailles for inspiration.///

Having a nationwide snap poll is not without precedence ...? Look at the recent UK snap ge?

To "repair the damage to sinkieland and garmen moral authority to rule so that sinkies and sin land can move on in their everyday lives", a general snap poll is less likely "to be seen as illegitimate, undemocratic, not credible" ...?

Must respect the moral guts and rectitude of UK PM Theresa May to hold a snap poll recently in view of recent events (in UK) ...?

Many sinkies said openly they dun bother about it but deep down it has already inflicted an indelible doubt and cast a long dark shadow in their subconscious ...?

Let the pple decide?

Once the people has decided (in a democratic process), many kaypoh may have to shut their mouth on much of this matter?

Letting matters rankle unabated in the general populace may not be wise and likely affect the mental cognizance of many pple going about their daily lives and their decisions on mid, long term matters ...?

In Sinkieland, everything is under the control of the powers that be. So, what comprise the ministerial committees, election committees, presidential committees etc are all of one kind of people and that is kaki-nan, otherwise how can they be on such committees? Greed, Ego and Other Vices, some of which are made Engines to drive Ecobomic Growth have made Sinkies commit more sins than crimes per se.
Look at the increases in costs of livings which despite so, did not stop Sinkies from driving costlier and bigger cars, buy expensive but smaller pigeonholes and buying non essential gadgets and spend lavishly on tours and other leisures.

The Ways the Youngs behave today are self-centred, rash and much lacking in consideration for others. Many are ill-disciplined, just look at the Ways they threw bicycles down from highrise building, into the drain and anywhere not meant to be.

lt is truly a great failure of the Leadership to nurture a nation with virtue and value. The Educational System is also a total failure in the lnculcation of desirable values.

Dear Mr Paul Lampard @ June 21, 2017 2:28 pm

Thanks for teaching us Singaporean dafties about the "Organs of State" in Singapore.

Can you please explain the meaning and significance of "separation of powers" as it relates to "Organs of State"

I read somewhere that:
"The doctrine of separation of powers is based on the acceptance that there are three main
categories of government function, that is: Legislative, Executive, and

Corresponding to that there are also three main organs of the government in a state
– the Legislature, the Executive and the Judiciary.

The doctrine insists that these three powers and functions of government in a free democracy must be kept separate and exercised by separate organs of the state.

(Page 5 & 6)

According to Montesquie (his book The Spirit of the Laws published in 1748) the
secret behind the liberty enjoyed by the English society was based on the separation and functional independence of the three arms of government.

According to Montesquie the consequences of lack of separation of powers are grave.

To be continued .....

Anonymous said...

@ June 21, 2017 2:47 pm @ Separation of Powers con't

“When the legislative and executive powers are united in the same person, or in the same body of magistrates, there can be no liberty, because apprehensions may arise, lest the same monarch or senate should enact tyrannical laws, to execute them in a tyrannical manner.

Again, there is no liberty if the judicial power be not separated from the legislative and

Where it joined with the legislative, the life and liberty of the subject would be exposed to arbitrary control: for the judge would then be the legislator.

Where it joined with the executive power, the judge might behave with violence and oppression.

Miserable indeed would be the case, were the same man or the same body,
whether of the nobles or of the people, to exercise those three powers, that
of enacting laws, that of executing the public resolutions and that of
judging the crimes or differences of individuals.

Essentially what Montesquie abhorred was absolutism and concentration of powers in one authority or organ of state.
It is the same principle that this realization came at a great cost to democracy and human rights in Europe. As was correctly pointed out by Lord Atkin:
“Every power tends to corrupt and absolute power tends to corrupt absolutely.”

Yes, you are right about the "organs of state" mentioned by Lee Hsien Yang.
And the concept of separation of powers.

Separation of powers, refers to the division of responsibilities into distinct branches to limit any one branch from exercising the core functions of another.
The intent is to prevent the concentration of power and provide for checks and balances.

This is opposite to the Singaporean concept of "own self check own self".

"Own self check own self" probably originates from the Chinese people's long history with the Chinese emperor system of government.
The Chinese emperor (one person) controls all three functions of government: Executive, Legislative and Judicial.

Do you think Chinese people are probably born to be slaves to emperors?
Do you think any education in the finest western universities can ever rid Chinese people of the emperor-slave mentality?

Yours Sincerely

The allegations of abuse of power, abuse/misuse of state organs and dishonourable conduct against the Prime Minister by his own Brother and Sister are severe and serious. His Excellency, The President of the Republic of Singapore should not be keeping silent. He had a role to play here.

Since the PM is personally accused of such serious charges, he should not be allowed to make statements to influence public and ministerial and judges' opinions.

The President should convene a Really and Truly Independent Presidential Commission (comprising at least FIVE High Court Judges who are not in any way close to the PM) to investigate into these allegations and ask the PM to take leave of absence so as to prevent him from influencing the Investigations. CPIB, SID and MSD should be directed to assist the Presidential Commission of Inquiry in every way they can.

Is it not within the power and purview of the President to do so?
