As expected, Law Minister K Shanmugam went to great lengths to deal with the obvious as well as unsaid issues – from his end of the debate, that is.
'Nine hours is lengthy, as parliamentary debates go. That was the amount of time spent in Parliament on the PartiLiyani case. But it will, by no means, settle the question of whether justice will ever be impeccably served, not if a substantial portion of the proceedings was taken up essentially by a detailed, if well-delivered, self-defence of the current system. Not by a long shot, I am afraid, if the government insists on believing that it can OwnselfCheck Ownself.' Tan Bah Bah in Yahoo News.
KNN, 9 hours still not enough ah? Still got doubts meh?
Shanmugam has spoken. The god of Singapore's law and enforcement system has spoken that there is no wrong doing, no favouritism for elites, all is fair and just. Singapore's legal system and the whole govt will not stand if there is biases in the legal system to protect a certain group of people, ie the natural aristocrats as some quarters seemed to suggest, or the social media seems to say so. For saying so in Parliament, just like Hsien Loong made his defence in many cases about the integrity of the system, the integrity of the legal system and Singapore's pristine incorruptible and fair and just system stay clean and above reproach.
' Shanmugam also reiterated a problem which he said he had brought up before – that of police officers working under tremendous pressure but which he nevertheless recognised as being part of a larger manpower shortage issue.' The pressure the police officers are facing is due to work overload not the kind of pressure that came from political interference or the heavy weights of the elites sitting on them. Get this clear. 'Equally important, there shall be no soft, less obvious, corruption where old school ties or family connections will grant one special dispensation.'
'And he was satisfied from the ministry’s investigations that the AGC and police had not veered from their professional impartiality.
And Attorney-General Lucien Wong? Shanmugam: “I can be categorical; there was no influence by Liew MunLeong. It was treated as any other theft case and handled accordingly.”'
There shall not be any doubt that Singapore has an impeccable and unquestionable legal system and govt, or else Singapore would not be able to look at other countries and stand tall, full of righteousness and correctness. Everyone in Singapore is treated fairly and equally under the law, even for foreigners also.
So, Parti Liyani has been treated fairly in the Singapore legal system. Anyone that has done wrong, or done her wrong, has been checked and cleared. No one that has done her wrong is free or go Scot free under the Singapore law.
Case closed. Let's move on. No more talks of whether justice is seen to be done. Singapore has a perfect or near perfect govt and justice system that will check itself, ownself checks ownself and beyond repute.
Singaporeans are so lucky. This is like paradise. Parti Liyani can go home now, feeling good that she has been fairy treated in Singapore.
Tan Bah Bah ended his piece by asking, 'Will there be an end to the public disquiet? A big No, unfortunately.'
Sob, sob. It's over. It's over.
PS. The moral of the story, natural aristocrats must not try to gain differential access to the judicial system or govt system for their own advantage. Oops, thank God none of them ever try and get caught for it. Heng ah.
What is this?
Lawyer M Ravi, who has been representing a number of inmates on Death Row lately, said on Wednesday (Nov 4) that he had filed a suit on behalf of Gobi Avedian against the Attorney General (AG), the AG’s office, Lucien Wong and eight other Public Prosecutors.
Mr Ravi wrote: “This suit is filed on the ground of abuse of power in
the manner in which the 9 prosecutors dealt with Gobi’s case”. theindependent.sg

The Main Cause Of A Country's Collapse
ReplyDeletePeople change as they get older. Everybody. Not even a single exception.
People with money, tons of them, crazy rich and filthy wealthy, change even more than ordinary folks.
People with power, prolonged power, unfettered power and absolute power, change beyond recognition and understanding by the common folks. Even their relatives and friends cannot recognise or understand them anymore. And even they are not able to recognise or understand themselves. Ultimately, they don't even know what they are speaking about, especially when they speak in public. Why?
Simple. After so long in power, the power becomes a form of opiat, a kind of drug even more powerful than the power itself. This power drug gets into their heads. They eat with power. They sleep with power. They dream of power. They even shit out power. Then they start to imagine and hallucinate that they are Gods, or Mini-Gods, or Sons of God, or God's right-hand and left-hand Angels, or God's annointed Saviours, or God's Appointees or at least God's Gifts to mankind.
That's where the downfall starts.
The rot starts with their inner selves. Soon it manifests outwards. Then it permeates into the society and environment, perversely and pervasively all-encompassing. Then the whole nation rots together. Majority of the common folks don't even know what hits them.
The ultimate collapse is inevitable. It is not a matter of if but a mater of when.
The power incumbents will try to delay the collapse as long as possible. Meanwhile, painting a rosy picture to the world, a fantastic too-good-to-be-true pseudo self-imagined vision of the future - for example, a smart city, an eco-city, Shangri-la or Swiss Standard of Living, etc.
As they dull and lull the minds of the masses, they quickly hasten themselves to fill up their own bank accounts at all costs. Time is the essence. Time is $MONEY$. To them.
When the inevitable happens, the common folks are left to carry the babies. To suffer the unspeakable and unimaginable consequences. But those who have enriched themselves have already flown far away, together with their families, relatives and cronies - into another world, another dimension....
This is the irony of trust, of truth and of transient existence.
Did Shanmugam Breach the Constitution When He Discussed the High Court Judgement in the Parti Liyani Case?
ReplyDeleteNovember 13th, 2020
Article 99 of the Singapore Constitution states:
The conduct of a Judge of the Supreme Court or a Judicial Commissioner, a Senior Judge or an International Judge of the Supreme Court shall not be discussed in Parliament except on a substantive motion of which notice has been given by not less than one-quarter of the total number of the Members of Parliament.
I have already criticised the Minister for Law’s statement on the Parti Liyani case in a previous blog (Shanmugam Abuses Parliamentary Privilege to Retry and Convict Parti Liyani). Shanmugam went out of his way to exonerate Mr Liew, the Attorney General’s Chambers (AGC) and the District Judge while at the same time casting doubt on Pari Liyani’s innocence.
However Shanmugam also appears to have breached Article 99 by going beyond this to implicitly criticise some of the High Court Judge’s findings. For instance, on the question of whether the Liews had an improper motive in filing a police report against Ms Liyani “Shanmugam thinks it is a “fair assumption” that the High Court intended to say there was a reasonable doubt as to whether the Liews had an improper motive, not that they in fact had an improper motive.”
However the High Court Judge is quite explicit in his judgement when he states that:
In the light of the above circumstances, the Defence has sufficiently demonstrated an underlying factual basis in support of its allegation of an improper motive on the part of Karl and Mr Liew.
Shanmugam undermines this by saying that “further investigations have shown that the Liews had told their maid agency by end-2015 that they wanted a new helper as they had suspected Ms Parti of stealing” though he says that the Judge was not aware of this as it was not raised by either side.
I have said enough about this case elsewhere. I am concerned here with whether Shanmugam breached Article 99 by discussing the conduct of the Judge without a “substantive motion of which notice has been given by not less than one-quarter of the total number of the Members of Parliament.” This condition does not appear to have been fulfilled. There was a procedural motion by Indranee Rajah to lift the application of the Standing Order which says that reference should not be made to matters which are pending before the courts.
The Code of Conduct governing Supreme Court Judges can be found here. It appears to largely follow the UK Supreme Court Guide to Judicial Conduct, following the SIngapore Government’s pattern of always adopting the UK model, modern or imposed during colonial times, as long as it aids or does not weaken their desire for total control. While there is no suggestion that Shanmugan has impugned the honesty and integrity of Justice Chan Seng Onn he does seem to be criticising the judge indirectly on the grounds of diligence by suggesting that it is difficult to understand “why the judgement has been reached in a certain way” (p. 13).

ReplyDeleteDid Shanmugam Breach the Constitution When He Discussed the High Court Judgement in the Parti Liyani Case?
It is not clear whether Article 99 of the Constitution was in the original 1965 Constitution or one that was introduced by LKY or his son to prevent an Opposition MP (presumably JBJ as the current WP MPs are always careful not to rock the boat too much) from criticising the independence of the judiciary.
If it is the latter then it is ironic that Shanmugam may have broken the limits his leader introduced. However the PAP have always flouted the Constitution when it suits them as shown when I took the Government to court over their breach of Article 144 of the Constitution over the US$4 billion loan commitment to the IMF. In that suit the Court of Appeal decided that Singaporeans did not have locus standi to apply for judicial review of Executive decision. The Government has also amended the Constitution only slightly less frequently than LHL changes his underwear because the PAP have always held at least 90% of the seats in Parliament. In addition the Judiciary, from the time of Wee Chong Jin (LKY’s best buddy in violation of the Supreme Court Code of Conduct) and Yong Pung How has continually taken the position that it is not within its scope to review the Executive’s actions. So Shanmugam, like his master, is on pretty safe ground in doing whatever he pleases.

Traitors, Traitors Everywhere; Not A Country Can Be Spare'd
ReplyDeleteIntroduction
Traitors are public enemies number one because they are the most cunning, slimy, vicious, unscrupulous and dangerous, and they can create the most harm to their motherland, to their people.
Traitors are like cancerous cells that exist in our body stealthily to devour and convert all the good cells into cancerous cells and grow to enormous size and power, and then together they finally caused the self-destruction and demise of our body.
Traitors existed since time immemorial. They exist in every country and every corner of the world. They can be found in our own families, in private enterprises as well as in government ministries, departments and agencies.
Main Objective of Traitors
The main objective of most traitors is to sell out their families, companies, organisations or countries for selfish purposes - money, sex, status, power or vengeance.
Some of them have been discovered, identified, caught and duly punished.
Some of them, though identified but are still free to do havoc to their own families, companies, organisations, countries and countrymen because the masses are either powerless or so disunited to be able to bring them to task.
However, many of them have not been identified nor discovered because they are able to hide behind the laws and inside the organisations from which they operate. These are usually people working as double-agents or even triple-agents.
Traitors Must Be Exposed
All traitors of their countries and of their people must be identified and singled out, and publicly shamed and forced to quit any position of power and political office they may be holding. They must also be banned from holding any government or private appointments where they can assert influence on the future of the country.
How To Deal With Traitors
The best way to deal with traitors is either by public execution or jail for life.
The latest example of a traitor uncovered:
The Headline
Nagorno-Karabakh: Armenian Protesters Urge 'Traitor' PM To Quit
Armenian citizens are protesting against the decision of their government to allow foreign invaders to keep several huge states the invaders have captured and are calling for the Armenia's Prime Minister, Nikol Pashinyan, to quit after he signed a peace deal with Azerbaijan, to end the fighting over Nagorno-Karabakh.
Under the Russian-brokered deal, the Armenian PM allowed Azerbaijan to keep the areas it has invaded and captured in the recent conflict.
Conclusion
Capitulation to foreign invaders (or investors) is a direct indication of a weak leader with a traitorous character. It is tantamount to selling out your people and your country to foreigners. It is inexcusable and unpardonable.
P/S: Once a traitor, forever a traitor, down to the descendants. It is in their DNA!

ReplyDeleteThis is Singaporean justice. Elites can do no wrong. As long as you belong to the elite class of Singaporeans, you can be rest assured you are protected. Lets move on.

Another Group Of Traitors Revealed Their Hands!
ReplyDeleteHong Kong's pro-Western, anti-China, anti-Government, pretentious pro-Democracy Lawmakers, instead of helping the HK Parliament to make good, patriotic, pro-national and pro-locals' laws, have deliberately resigned en masse, all 15 out of 19 of them (4 others have already been disqualified and dismissed as undesirable anti-national elements out to sabotage national unity and progress).
They openly held a press conference in Hong Kong yesterday in order to continue their ulterior motive of blemishing, demonising and damaging the good names of the Local HK Government and the Central Chinese Government.
This group of traitors have been trained, groomed, financed and directed by anti-China Westerners to pretend to fight for independence, but actually to cecede the island to Britain or USA. They have been at this traitorous game for the past four years, since the staunchly anti-China Donald Trump came into power as the US President on 20 Jan 2017.
These traitors of the Chinese people have just resigned en masses, after the expulsion of four of the members of their cecessionist gang.
The mass resignation of these Western stooges, who have managed to infiltrate into the HK Parliament as lawmakers, has raised fresh questions about their loyalty to Hong-Kong and to China, exposing their hidden motive of becoming Hong-Kong's lawmakers.
The future of the territory's well-being and stability has now been shakened and threatened by this small group of Traitors, who have disguised themselves as the true and sincere dissenting voices of the Hong-Kong people.
"We owe a display of solidarity with our colleagues who were ousted. We need to protest against what could be the ultimate Beijing crackdown on Hong Kong - to silence the last bit of dissent in the city," said Ms Claudia Mo, one of the 15 Western stooges who announced the walkout on Wednesday.
"They're lining us up to oust us bit by bit. What's the point of staying on like this, thinking will I be ousted today or not?"
Hong Kong has witnessed a rapid erosion of its economy, security and global financial status since these treacherous Western puppets started to create disturbances, disruptions, chaos, riots and violence under the direction and instructions of Western Powers (especially Britain and USA) that have been secretly and openly instigating, encouraging, supporting and financing them.
They intend to turn Hong-Kong into a lawless city so that they can do whatever bidding their Western Masters instruct them to do. That is why they are very much against any law that they deemed disadvantageous to their treacherous cause of helping Western Powers to seize Hong-Kong and put them up as the defacto Hong-Kong Governor and Representative of the West.
China and the Chinese people must, once and for all, eliminate and destroy these traitors, in order to stop them from creating further havoc to the lives of peaceful and patriotic commoners in Hong-Kong and neighbouring cities. They should not be allowed to enter the HK Parliament ever again.
It would be stupid and careless to let them continue along the same destructive path again and again. Four years of unrest and destruction is long enough. In fact, much too long already. Serious damages have already occurred again and again. The costs are immeasurable.
The time has come to take a strong stand and carry out deterent actions so as to convey a distinct, unmistakable and definitive strong message to all these traitors and perpetrators of chaos and instability in Hong-Kong and elsewhere within China.
No decent government should allow or, worst still, facilitate the growth of Traitors within the ranks.
It is good that these traitors stood up to be identified. With the new anti China law, these would be locked up in a matter of time unless they fled to be with their foreign masters in the US or wherever.
ReplyDeleteTime for cleaning up Hong Kong and becoming a part of China proper. The next group to be put behind bars will be the foreign judges. They now have to be very very careful in how they handle cases that are traitorous in nature. If they any how release the traitors and let them go free, then they will end up being arrested themselves.
It is about time.
